Jaipur, March 4, 2025 – The Rajasthan High Court, Jaipur Bench, has granted bail to Mahendra S/o Kaluwaram, who was in judicial custody in connection with an FIR registered under the SC/ST (Prevention of Atrocities) Amendment Act and various sections of the Bhartiya Nyaya Sanhita (BNS).
The bail order, passed by Hon’ble Justice Anil Kumar Upman on February 24, 2025, overturned the previous rejection by the Special Judge (SC/ST Atrocities Cases), Sawai Madhopur, on December 11, 2024. Mahendra, a resident of Chhoti Udei, Gangapur City, had been in custody since December 8, 2024.
The case stemmed from an allegation that Mahendra inflicted a firearm injury on the complainant, Muniraj Meena. However, the defense argued that the medical report contradicted this claim, showing no such injury on the left hand of the complainant, though a minor injury was found on a finger of his right hand.
Opposing the bail plea, the prosecution cited Mahendra’s involvement in three other criminal cases. The complainant was reportedly absconding in another case, which led to his absence from the bail hearing.
After reviewing the nature of injuries, period of custody, and likelihood of a lengthy trial, the Court granted bail to Mahendra, setting aside the lower court’s order. The bail conditions require him to furnish a personal bond of ₹50,000 with two sureties of ₹25,000 each and to appear before the trial court as required. Additionally, he must mark his presence at the local police station every month and avoid any similar offenses, failing which his bail may be revoked.
The Court clarified that its observations were limited to the bail proceedings and would not influence the trial’s outcome.
